Water Right Transfers
Your Oregon water right certificate is specific to a “place of use, point of diversion, and type of use.” Before changing any of those attributes, you must file a transfer application with the Water Resources Department.
For instance, say you hold a certificate for the irrigation of Tract A with water from Stream A. As weather patterns and crop needs evolve, you’re contemplating a few water use changes.
Idea | Potential legal impact |
Use Stream B to irrigate Tract A | Change in point of diversion |
Use Stream A to irrigate Tract B | Change in place of use |
Use Stream A to supply livestock on Tract A | Change in type of use |
These scenarios are simplistic and not remotely exhaustive. What constitutes a change isn’t always so black and white. Neither is the type of transfer.
Scott Fein’s team at Water Rights Pro can help you determine the necessity and nature of changes, prepare all documentation, and complete the OWRD transfer application as quickly and smoothly as possible.
