New Water Right Applications
There are three steps to obtain new water rights in Oregon:
- Apply for an Oregon Water Resources Department (OWRD) water use permit.
- Build and start using the project exactly as described in the permit.
- Submit a claim of beneficial use (COBU) survey. This generally requires a Certified Water Rights Examiner, and must happen by the earlier of a) one year after making full use of the water or b) the permit’s completion date.
The application process comprises several documents and maps. They differ slightly for groundwater, surface water, and reservoir projects.
A complete and justifiable application does not guarantee a permit. The State will also consider your application in the context of public impact, pending legislation/policy changes, and the intersection of local, state, and federal regulations.
Following the COBU process, your permitted water amount is generally irrevocable (if it’s not misused). However, all Oregon water rights are subject to prior appropriation. During shortages, the full amount may not be available if others hold more senior rights to the same source.
