Who Is Affected by Oregon’s Process Updates

Beginning January 1, 2026, Oregon is standardizing decision document names and adding an automatic path for some decisions to become final 33 days after the public notice window closes if no timely objections are submitted. The updates apply only to specified water right processes issued on or after that date.

Applicants

If you receive a Proposed Final Order for a covered action, track the response deadline listed in the notice. When the notice window closes with no objections and the Department does not withdraw the decision, it becomes final on day 33. Plan reviews and internal approvals around that timeline.

People or organizations who may object

Timely objections must be in writing and include contact information and any required fee. They should explain your interest or a public-interest basis, identify specific issues, and provide supporting facts or citations where known. Raise all reasonably ascertainable issues during the notice window so the record is complete before a decision can finalize.

Supporters seeking to participate

If an objection is filed and the matter moves forward, a person who supports the Proposed Final Order may request party status within 30 days after the notice window closes, following the Department’s procedures. This is the path to participate in a subsequent contested case tied to that file.

Agencies, Districts & Watermasters

Irrigation districts, municipalities, and other entities that manage diversions should align internal calendars with the standardized terms. Using “Initial Review” and “Proposed Final Order” consistently helps staff recognize milestones and coordinate mapping, device planning, and operating records on the same schedule as applicants.

Matters spanning the effective date

For covered actions issued on or after January 1, 2026, the new terms and timelines apply. For pending matters not yet referred to hearing by that date, the Department may notify participants about how to meet the updated objection or party-status requirements. Follow the instructions in that notice; no action is expected until it arrives.
